Everything in writing, nothing hidden
The ground rules for working together: what you get, what I promise, and where we both stand. Written to be read, not buried in legalese.
These terms cover all website plans, website builds, hosting, maintenance and digital marketing services provided by Travers & Co. to clients in South Africa through traversandco.co.za ("we", "us", "I"). By signing up to a plan or commissioning work you agree to them. Questions first? Email sales@traversandco.co.za.
1. What you get
Each plan and service includes exactly what's listed on the pricing page at the time you sign up. Basic and Professional website plans include the design and build of your site, written content, your photos placed properly, hosting, an SSL certificate, your domain, the stated monthly update time and support.
2. Timescales & touch-ups
Basic and Professional websites go live within 1 week of me having everything I need from you: the details from your start-a-project form, your photos, and your logo if you have one. If anything's missing I'll tell you exactly what within one working day, and the week starts the moment it arrives. Corporate builds follow the timeline agreed in writing in your quote.
Every build includes three rounds of touch-ups. A round works like this: you look at the finished site, send me your changes in one go, and I make them. One message with ten changes is one round; ten messages with one change each is ten rounds. Fixing something I got wrong doesn't count as one of your rounds. After the third round the site goes live as it stands, and further changes are handled through your monthly update time or as extra work (section 8).
3. Monthly plans & billing
- Basic Website, Professional Website, Website Maintenance and all digital marketing services are monthly subscriptions, billed in advance by card or debit order, or paid by EFT.
- There is no setup fee on Basic or Professional plans. Billing for a website plan starts when your site goes live; billing for a marketing service starts when the work begins.
- Plans run month to month. You can cancel any time with 30 days' written notice — no exit fee.
- Monthly update time is there to be used that month; unused time doesn't carry over.
- You can move up a plan from your next billing month, and down a plan once your site fits within it.
- If we ever change a plan's price, you'll get at least 30 days' notice first, so you can decide whether to continue.
4. Corporate builds
Corporate websites are quoted individually. The quote sets out the pages, features, timeline and price in writing, and work starts only once you've approved it. Unless your quote says otherwise, the build is invoiced once the site is live and you've approved it, payable within 7 days. Once live, Corporate websites are covered by Website Maintenance at the monthly rate shown on the pricing page.
5. Ownership & cancelling a website plan
Your domain is registered in your name and is always yours. So is everything you supply: your words, photos, logo and other content.
On Basic and Professional plans, the website design and code are licensed to you for as long as your plan is active. If you cancel and want to keep the site itself, you can buy it outright for the balance of 12 months of your plan, minus what you've already paid. After 12 months there's nothing to pay, and I'll hand over the complete site files on request. Corporate builds become yours in full once the build is paid for.
6. Digital marketing services
- Advertising spend is separate. Google Ads and Meta ads budgets are paid directly to Google or Meta by you, in accounts registered to you. I never mark up ad spend.
- No ranking guarantees. Nobody controls search engine rankings or platform algorithms. I promise to do the work described, properly, and to report on it honestly each month.
- Social media posts are shared with you for approval before scheduling. If you don't respond within 5 working days, I may schedule the planned posts so your pages don't go quiet.
- Google Business Profile verification is Google's decision and outside my control.
- All accounts I set up for you (Google Business Profile, Ads, Analytics, Tag Manager, Search Console, social and ad accounts) belong to you, and your access remains if you leave.
7. Response times
- Edit requests: completed within 24–48 business hours on Professional, Corporate and Maintenance plans, and within 2–3 business days on Basic.
- Website offline: restored within 2–4 business hours of being reported or detected.
These are genuine working targets, not guarantees, and depend on third-party platforms behaving (section 10). Business hours are Monday to Friday, 8am–6pm South African time, excluding public holidays.
8. Extra work
Need something your plan doesn't cover — extra pages, custom features, a redesign, additional design or copywriting? I'll quote it, you approve it, and only then does it get done, billed at R500/hour in 15-minute blocks. If you need me overnight, at a weekend or on a public holiday, that time can carry a surcharge of up to 100%. Nothing is billed without your approval.
9. Your content & deadlines
You confirm you own (or hold a licence for) all content you supply — photos, logos, text — and you indemnify us against claims arising from it. If a project sits waiting on your material for more than 30 days, I'll park it and we'll agree a fresh timeline. The same applies to touch-ups: if a round of feedback sits with you for more than 30 days, the site goes live as it stands, and anything further is handled under section 2.
10. Hosting & third parties
Sites are hosted on reputable modern platforms targeting 99.9% uptime. I take a backup before every change and keep 30 days of backups, though no backup system can promise a perfect restore every single time. We are not liable for outages, price changes or policy changes at third-party services — domain registrars, hosting providers, Google, Meta, Microsoft and the like.
11. Late payment
If a monthly payment fails, I'll let you know and try again. If a payment or invoice is more than 14 days overdue, I may pause services until it's settled, where the law allows.
12. Portfolio
Our internal tools, templates and processes remain ours. We may show completed work in our portfolio unless you ask us not to.
13. Privacy
Personal data is handled in line with the Protection of Personal Information Act (POPIA). See the privacy policy for details. We collect only what's needed to do the work and never sell your data.
14. Cooling-off & cancelling a build
If you buy as a consumer online, the Electronic Communications and Transactions Act may let you cancel within 7 days, and the Consumer Protection Act gives a 5-business-day cooling-off period for direct marketing sales. If you ask us to begin work within that period, you agree that the work can start and that you'll pay for work done up to cancellation. If you cancel a Corporate build partway through, work completed to date is invoiced at the hourly rate in section 8, capped at the agreed build price.
15. Liability
Our total liability is limited to the fees you paid us in the previous 12 months, to the extent permitted by law. Nothing in these terms limits liability that cannot legally be limited, and nothing affects your statutory rights, including under the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002, where they apply.
16. Governing law
These terms are governed by the laws of the Republic of South Africa, and disputes fall under the jurisdiction of the South African courts.
